At this point it seems like the company has not officially filed for bankruptcy, but it has ceased all operation and handed in their flight operating license.

Air passenger rights when an airline goes bankrupt.

Many passengers are now stuck at airports and others are worried about their upcoming flights. When an airline goes bankrupt passengers have certain rights and ways to minimize the damage.

Refund of tickets.

If the airline tickets have been bought with credit cards we recommend consumers to get in contact with the bank that handles the card and request their assistance to file for a chargeback. Consumers can also contact their card companies and request their assistance to get the chargeback.

If tickets have been bought with Netgíró, people can get in touch with Netgíró and request a refund. According to Netgíró´s statement, the company guarantees reimbursement of the ticket, if people can prove that the service wasn´t delivered.

If the flight is a part of a package travel we recommend consumers to contact their travel agency and request new flights.

If, on the other hand, a ticket has been bought with a gift certificate, bank transfer or with cash, there is little to be done other than to file a general claim against the airline or, if the airline goes bankrupt to file a general claim in the company's bankruptcy estate.

Right to a compensation.

Passengers may be entitled to standard compensation on the basis of a European Air Passenger Rights Regulation, if the flight is canceled less than two weeks in advance. The amount depends on where you are flying. For flights between 1,500 km and 3,500 km (or flights between two EEA countries), the amount is 400 EUR per passenger. If the flight is longer than 3,500 km (e.g. from Iceland to the US) then the amount of the benefit is 600 euros per passenger. To claim this right, you must file a claim against the airline. In the event of a bankruptcy however, it would be necessary to file a general claim in the bankrupt estate.
